Lawsuit Information

Dozens of individuals who were seriously injured after taking Yaz, Yasmin, Ocella, Zarah or Gianvi have filed lawsuits against Bayer and other related entities.  The Plaintiffs allege that they suffered injuries, including deep vein thrombosis (DVT), pulmonary embolism (PE), heart attack, stroke, kidney failure, seizures, gall bladder injuries, and death after using these birth control pills.

Litigation involving personally injuries sustained from using dangerous drugs like Yaz, Yasmin, Ocella, Zarah and Gianvi are usually not pursued as class action lawsuits.  Instead, separate lawsuits are filed by individuals and families injured by the drug.  Often, in cases like these, the lawsuits are consolidated into an MDL (Multi-District Litigation).  A Petition was filed on July 24, 2009 seeking to consolidate the Yaz, Yasmin, Ocella, Zarah and Gianvi cases in an MDL.  The MDL Panel will hold a hearing in September to determine whether the cases should be consolidated.

[UPDATE] In October 2009, the Yaz / Yasmin litigation filed in federal courts was consolidated in an MDL in the Southern District of Illinois.  As of the end of July 2010, close to 3,000 Yaz lawsuits have been filed in the MDL.  The first Yaz lawsuit trial is scheduled for 2011.

[UPDATE] By September 2010, more than 4,000 Plaintiffs have filed lawsuits against the makers of Yaz, Yasmin and Ocella in the federal and state court Yaz litigation.

In addition to the cases filed in federal court and subject to a potential MDL, many Plaintiffs are filing suit in state courts around the country including California and Pennsylvania.  Currently there are statewide Yaz lawsuit consolidations in California, New Jersey and Pennsylvania.  

The Yaz attorneys at Jackson Allen Williams, LLP are familiar with federal court MDLs and state court cases involving defective drugs.  Our Yaz lawyers will work with our clients to determine the best course of action in each particular case.  Presently, our Yaz attorneys have filed Yaz lawsuits on behalf of our clients in both the federal court MDL and in the consolidated state court actions.  We are also actively assisting in reviewing documents produced by Bayer to aid in the preparation of the Yaz cases for trial.
