Bellwether Trial Schedule Established for Yaz, Yasmin Cases in Pennsylvania
The Pennsylvania State Court Judge Sandra Moss overseeing the consolidated litigation involving Yaz and Yasmin birth control pills has established a bellwether trial schedule similar to the one recently ordered by the Federal Court Judge in the Yaz, Yasmin MDL in Illinois.
According to the order issued last month by Judge Moss, two cases in Pennsylvania state court will be set for trial from each injury group, one selected by plaintiffs and one selected by defendants.
The first two cases to be tried will be a pulmonary embolism case just like the plan for the Federal Court MDL bellwether trials. The first case will begin on September 26, 2011 and will be a plaintiff-selected case. The next case will begin October 24, 2011 and will be selected by Defendants.
The next round of cases will involve women who suffered gallbladder injuries. The first case again being selected by Plaintiffs and the second by Defendants. The first gallbladder injury case is scheduled to begin January 23, 2012 and the second on February 20, 2012.
The third group of trials will include venous thromboembolism injuries other than pulmonary embolisms. The first, a Plaintiffs' pick, set on April 30, 2012 and the second, a Defendants' pick, on May 30, 2012.
