First Yaz Case to Trial September 12, 2011
The Judge overseeing the Yaz / Yasmin multidistrict litigation has ordered that the first Yaz/Yasmin lawsuit go to trial beginning September 12, 2011. The Court's order detailed the process for determining which of the over 4,000 cases will be tried first. According to the Judge's order, the first Yaz trial will involve a woman who suffered a pulmonary embolism as a result of taking Yaz. The next case to trial will involve a Yaz user who suffered gallbladder disease and had her gallbladder removed. The third trial will involve a woman who suffered a venous thrombolic event whether it by deep vein thrombosis (DVT) or pulmonary embolism (PE) or both.
In determining which cases will be selected, the Judge has ordered Plaintiffs attorneys and Defendants' attorneys to each select 25 possible trial cases. These fifty (50) Yaz / Yasmin cases will be "worked up" for trial including written discovery and depositions of the relevant witnesses. Which case will be chosen as the first bellwether trial will be determined closer to the trial date.
