Preliminary Yaz/Yasmin Bellwether Case Selections Completed
Members of the Plaintiffs Steering Committee and Defendants Steering Committee have chosen the first twenty-four Yaz/Yasmin cases from which the first bellwether trials will be chosen. Plaintiffs and Defendants each got to select twelve cases to form this "discovery pool" of cases. The Yaz/Yasmin cases in this discovery pool will undergo case-specific discovery between now and November 2011. The first type of Yaz/Yasmin lawsuit to be tried will involve a pulmonary embolism. Case specific discovery for the pulmonary embolism cases will end in April 2011. The next bellwether case set for trial will involve an injury to the gallbladder including gallbladder removal, gallstones or other disease of the gallbladder. The deadline for discovery in these cases is September 2011. The third Yaz/Yasmin lawsuit to be tried will include some form of venous thromboembolic event, including pulmonary embolism, deep vein thrombosis or other VTE. Discovery for these cases ends in November 2011.
Following the completion of the first round of case specific discovery in April, four of the eight pulmonary embolism cases from the discovery pool (two selected by Plaintiffs and two selected by Bayer) will be submitted to the court. The Court will then decide which of these four cases will be the first Yaz/Yasmin case to trial.
